On my way home from work today, I was sitting at a stop light when some idiot in a 2004 Lexus rear ended me. I am so beyond mad. My bumper is pushed down about six inches, the hatch won't open, the plastic piece on the inside of the gate is cracked in three places, the license plate is bent in half... How can you not see something as big as my truck? I felt a little morbid satisfaction as I watched her with her manicured nails and huge diamond ring call her husband. All she could say was, "Honey, I hit an Explorer"..... I hope the *i*** can't sleep tonight. She told the cop that she wasn't paying attention. I think we established that fact by the looks of my truck. I will post pictures soon. :eek:

Thats what insurance is for. I'm sure if she's driving a new Lexus and had a huge diamond ring she won't be losing any sleep over damaging a car she could probably easily cut a check for. If it were something she was really worried about she wouldn't have told the cops that she wasn't paying attention.

Keep us updated on how it turns out. If she had a lexus, you can bet she has good insurance. Make them fix every tiny detail you find wrong.

I'm going in the morning to get estimates and get my neck checked out. I'm gonna make her fix my truck, then let her settle out of court for my "neck injury" and pay my truck off. I will post pics and keep you up to date on the situation.

Your going to sue her for a 'neck injury'? Im assuming you put that in quotes, because you really dont have one.. :rolleyes:

Yeah no kidding. I don't like rich pricks any more than the next guy, but frivolous lawsuits piss me off.

Why is everyone assuming that this lady is a 'rich pricks' or was doing her nails etc? People make honest mistakes, and sometimes get distracted with every day things.. She told the officer that she wasnt paying enough attention.. and fessed up. I didnt read anything about her being snobby.

I am against suing people for injuries that are not real. Been on the recieving end of that one. As far as rich, read the edited quote above.

Who said her injury was fake? Quote's dont necessarily mean fake... if she is JUST going to get it checked out, it may or may not be a neck injury & therefore since she doesnt know yet, it deserves quotes... There really arent that many people who get away with the frivolous lawsuits anymore anyway.

:mad: Just an update to the situation. First off, let me say Thanks to all you people who turned on me in a second over a set of quotations. By the way, I went to the doctor to have my neck looked at for my "neck injury" and to all you who jumped to stupid conclusions, after fourteen xrays and two catscans, it was confirmed that I have two cracked vertabra in my neck. I am currently in a neck brace and I am seeing a neuro surgeon in the morning. Also, Thanks to Ranger_Princess for trying to set the story straight. MBrooks 420, F.Y.I. I am not a hater, unlike the owner of the Lexus, I bought my own truck, I didn't have Daddy buy it for me. She hit me, so she can pay for my truck. She admitted fault and even the police report says she admitted she was looking down and didn't look up in time to see me stopped. Thanks for letting your maturity level show. You obviously like to jump to conclusions like some others on here.
Also, today, I got estimates on the truck and they are ranging for one to two thousand dollars. The woman's husband called to appologize for her today. He said I am the FOURTH person she has rear ended. He said she had just gotten her Lexus back Monday from the paint shop where she had hit a bike. Then, on Saturday, she hits me. So, obviously, she has a history of "not paying attention". I am totally against sueing for fake injuries, but I think my xrays and catscans speak for themselves. I appologize for getting everyone so fired up, but please don't assume the worst about people. It's nice to know how some people really view me, but in reality, I am not that evil.

Yeah, sorry about your neck. I hope it heals well and fast. It's a shame when people don't respect the ability to drive. Hopefully this will make her realize that and stay off the road so no one gets killed.

However, please don't turn on everyone here. This is an internet forum and a lot of us don't know eachother. We don't know if you're telling the truth or lieing. By using quotes, you made most of the people here think you weren't telling the truth. It's an honest mistake. Just FYI for the future.

There can be a HUGE difference between

my neck injuries and my "neck injuries" :D

The worst part is the other woman (I won't call her a driver because she has demonstrated she isn't one) has a chronic habit of Not paying attention and causing accidents. She needs to have her license revoked before she injures anyone else (why wait until she kills someone?). If you're going to be cruising around in a 2 ton guided missile please have the damn courtesy to be paying attention!

I'm curious which Lexus she was driving and how fast she was going. It must have been one of their big SUV's, an LX 470?

I also would like to appologize for my attiutde and use of quotations. I am truly sorry for offending anyone and unintentionally causing a fight. That was not my intention. Again, I am sorry to everyone. I am not sueing her. My insurance is paying for my xrays, catscans and all that. All she has to pay for is my truck. The accident happened on Saturday and she still has not reported it to her insurance company. I hope this doesn't turn ugly. I just want her to fix my truck and I'll leave her alone. That's all I am asking for. Again, I am sorry to anyone I offended. Also, to answer your question, she was driving a Lexus RX 300 and she was going between 25 and 35 according to the damage. I had it appraised at the local Ford dealer. They quoted m about $3000 in damages. They noticed the frame is cracked and bent. They want to pull the frame and weld it. I hope it all works out.

I was in an accident right after I bought my 89 ranger (in 89). I was very upset at the time and threatened a lot of things. I never ended up suing her though. My insurance took care of my X-rays and a small amount of treatment (I was not hurt as bad as you are). What happened was my insurance made the woman's insurance pay them back after it was all over.

Make sure you inspect your X very closely now so you know every minor detail of the damage. Even write it down and take pics. When you get it back inspect everything again. A few of the body shops I have dealt with did not do all the work or didn't do it right. Most are good shops, but make sure its right. Its her insurance thats responsible to make it just like it was before the accident.

I completely agree... I am sorry to hear about your neck... I hope all goes ok! & I agree with Brian, but generally if you have the dealer do it, they are pretty good about doing everything (usually)... I just hope she never goes far enough to kill someone though... what she did to you was bad enough!

Actually, her insurance should pay your medical bills as well. Your injury was caused by the accident, and is thus the responsibility of her insurance. You may have to pay any deductibles, stc. but the other copany should reimburse you and/or your insurance company. Give all parties involved her insurance companies name, etc. to get the ball rolling. Anyway, I hope your neck heals quickly, and remember, it could have been worse.

Well, my wife has manicured nails, a large diamond ring, not a Lexus but a loaded Volvo XC90 which at over $50k costs more than an RX300 (and we bought it ourselves, no Daddy involved), and when she was in an accident she did indeed call me. She called me to let me know what happened and that she was OK. Would it have been OK for the other person (who caused the accident) to think, "Ah it's OK, she's some rich snob anyway, look at her manicured nails and big diamond ring."

So what does all this mean? Not a damn thing. All those things you pointed out are useless in judging someone. Yet you did when you stated you were happy at seeing that she had nice things. What if it had been someone driving an old clunker and wearing ratty old clothes. It annoys me to no end when people make snap judgements about someone because they have a nice car or something like that. I didn't realize that having some money instantly made them a jerk/ass/bitch. People know absolutely nothing about that person other than what kind of car they drive, clothes they are wearing, jewlery they have, yet they exactly what type of person they are.

One of my friends rear ended an Explorer yesterday I was pretty mad. I'm a senior in high school so I know a couple ditsy girls, of course she was texting on her phone and didn't pay attention. BUT, long story short the X wasnt damaged at all it smashed the hell out of the front of her Saturn though :rolleyes:

DocViJay, I am sorry if I offended you. The reason I spoke bad of her and her money is because she doesn't care about me or my truck. I called her insurance company today and she still hasn't reported it to them. I can't get the truck looked at until she does. More power to all those rich individuals out there. If we could all be rich, we would. Her and her husband try to use their money to get out of situations. Her husband told me she has paid off the last people she hit to avoid having her insurance rates jacked up. I can't stand people who use money to avoid punishment they deserve. Honestly, it's not the money, that makes someone a bitch, it's the atttitude they have. As soon as the accident happened, her husband tried to cut me a check to avoid reporting the accident. He is trying to protect his wife, when really, he should step back and let her lose her license. When the accident happened, she seemed seriously unconcerned, she didn't ask if I was alright, didn't look at the trucks, just called her husband and tried to come up with a story to make it sound like the accident was my fault. She told the cop that she was stopped behind me and looked down for a second and rolled forward into my truck. I have estimates from one to three thousand dollars. I think my neck and truck prove that she lied. She said she was traveling at five miles per hour. I am not sueing her, as long as my truck gets fixed, I won't mention this again. But, at this point, she hasn't even bothered to call her insurance company. How mature is that? I just want my truck fixed. Again, DocViJay, I do appologize to you and your wife. Sorry if I offended you.

Don't worry, I wasn't offended, just a bit annoyed. I wasn't trying to say that you were a bad person or anything. Trust me, you are not by yourself in this, most people make snap judgements, even me. If I yelled at someone every time I heard them say something just becuase of someones financial status I'd go completely hoarse in minutes. It's just easier to type things out in a forum.

As for offering money to avoind going through insurance, I see no problem with that. Get several estimates, pick the most expensive one, and get the cash from them. Saves time for you and them. The insurance company may only give you wha they feel is an appropriate amount, which is to fix the truck to the standards they see fit. Someone backed into me in a parking lot years ago. It was a very minor dent. We both had the same insurance company. It took me 6 weeks to get the check, and when I finally did, it was for almost half what the estimate was for. I called them and they told me it was becuase the estimate I got was way overpriced and they would not pay it. They got their own "estimate" and paid that amount. Last year we got rear-ended by a high school kid. He told us he'd rather pay than go through insurance. He could pay us the $500 once, or pay the insurance company $500 or more forever (or until he reached 25).

If this guy is willing to pay you the amount of the estimate, then by all means do it. You'll get the money sooner and won't risk getting stiffed for a lesser amount because the insurance comapny has a different "list of costs." As for the medical costs, I really can't tell you what to do about that. Either get another check from them, or just have him pay your bills. You can ask your doctors to get total cost and give him that figure, and just get one big check.

WHOA your telling me you have a neck injury and your thinking of letting them settle without telling there insurance O I don't think so..first in Missouri you can settle on car only settle if you have injury's DO NOT settle with out there insurance a neck injury can huant you the rest of your LIFE I have been in 2 wrecks not my fualt and settled on car only until MY doctor said My wife was okay...the insurace laws are there for that reason... Im not a sue freak... been on both ends but I would not let them un-bend my frame and weld it.... need to check and see if it buckled the fram under your seat have the alment check it may dogg track after this PS what year explorer if its a 95 or older 3,000 may total it!!!

Austin's Girl you take them to court and settle. If you have a neck injury (and why would you lieabout 2 cracked vertabra) make them pay. Wether or not she was driving a Lexus or an Explorer she has to be held accountable for her actions. Driving is a privlage not a right. If you abuse that right it should be taken away and you should be punnished for it. Mind you the punishment should fit the crime. Anyway my point is, my friend was rear ended at the age of 23,prime time for having babies and starting a life but that was all taken away by some guy who was driving an old honda "not paying attention". She was rear ended and has extreme back problems where she has to go for walking epidurals 1-2 a week just to cope. She has been told that she would be advised never to have children because the pain will be unforgiving on her. What did she get for never being able to work again or live a normal life?? $250,000. When you think of it what is that really?. Oh yeah and she went to 3 of Ontario's top ivestigator's and Dr's and they all deemed her incompasitated to work. Pretty hard to see someone of that age watch your children and wish they could have their own but can't because someone wasn't paying attention. It feel bad for the poor people who do not ever get things checked and live in pain for the rest of their lives because they are afraid of the repercutions, but yet you get these people who are full of B.S.,that live high off the hog from their false claims.
