Gasket in tranny

I am doing a tranny and filter service and I found a gasket in the bottom of the pan... dont know where it goes... fluid is nice and red with no burnt smell to it and transmission shifts good but does have a whining noise to it... please help so I can close up the transmission...

It's hard to tell from the photos, I cant tell how big or small the pieces are, but the material looks like the type used for the valve body to transmission case/separator plate.
Does the material crack and break like a potatoe chip, or is it flexible?

so i was thinking that maybe it could be the tranny pump gasket but the pump gasket is round and this gasket is more straight? i am looking online for all the tranny gaskets and still cant find a match...
