My attorney sends me monthly recalls on items. This month I thought it to be useful to all here as Ford and Mercury are listed in these recalls.

National Highway Transportation Safety Administration’s (NHTSA) Office of Defect Investigation (ODI) and Consumer Product Safety Commission (CPSC) announces new Recalls & Alerts:

    Kia Airbag Recall

Kia has issued a recall of approximately 145,000 vehicles due to a defect affecting the frontal airbags. The following vehicles are included in the recall class: 2006-2008 Kia Optima vehicles manufactured from September 29, 2005 through January 29, 2008 and 2007-2008 Kia Rondo vehicles manufactured from September 13, 2006 through March 21, 2008. Over time, the clock spring contact assembly for the driver's side airbag supplemental restraint system (SRS) may become damaged. If this occurs, the airbag electrical circuit may experience a high resistance condition that prevents the driver's airbag from deploying, significantly increasing the risk of enhanced injuries in the event of a crash.

The recall is expected to begin sometime in March 2012, and dealers will inspect the vehicle and perform the necessary service free of charge. Owners may contact Kia Customer Service directly at 1-800-333-4542 and reference safety recall no. SC094. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12V014000.

    Toyo Tire Recall

Toyo Tires has issued a recall of approximately 68,000 Extensa A/S tires (P225/60R16 97T) produced from September 20, 2009 through November 6, 2010. Some of these tires may have been produced with a kink in the bead area, which under certain circumstances can eventually crack. If left undetected, this can lead to tire failure, significantly increasing the risk of crash and catastrophic injuries.

The recall is expected to begin on February 2, 2012 and dealers will inspect the vehicle and provide replacement tires free of charge. Owners may contact Toyo directly at 1-800-442-8696. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12T002000.

    Britax Child Seat Recall

Britax has issued a recall of approximately 14,000 Chaperone Infant Child Restraint Systems produced from September 1, 2010 through April 30, 2011. The recall is due to a defect that can cause the harness adjuster to detach from the seat shell. If this occurs, a child may not remain properly restrained, significantly increasing the risk of enhanced injuries in the event of a crash.

Britax is expected to provide repair kits free of charge beginning on February 6, 2012. Owners may contact Britax directly at 1-888-427-4829. Proper safety restraints are critical to a protecting a child in a vehicle. Parents are encouraged to learn more about child passenger safety by visiting the safe kids section of our website. Consumer News: Sticky Accelerators Lead to Massive Ford Recall
    submitted by Adam J. Langino

The Associated Press recently reported that Federal safety regulators are investigating sticky accelerators in as many as 1.9 million Ford Taurus and Mercury Sable sedans. The National Highway Traffic Safety Administration has received 14 complaints of Taurus sedans self-accelerating. The agency is investigating whether a faulty cruise control cable is to blame as it has the potential to detach and hold open a vehicle’s throttle. NHTSA’s investigation started in March and originally included 360,000 model year 2005 and 2006 Ford Taurus’s. It has since expanded its investigation to include the 2001 through 2004 model year Ford Sable.

As an important safety reminder, per NHTSA, if a car suddenly accelerates, drivers should brake firmly without pumping the brakes, shift the car into neutral, steer to a safe location and shut off the engine. If a car has a keyless ignition, drivers should know how to turn off the engine while the car is in motion, which may involve holding the button until the engine turns off. Finally, drivers should familiarize themselves with their vehicle’s controls so they know in advance how to put their car into neutral.

    Consumer News: Foreclosure Abuse Settlement
    Submitted by Gregory S. Weiss

Florida’s Attorney General formally entered a landmark $25 billion joint federal-state agreement with the nation's five largest mortgage servicers over foreclosure abuses and unacceptable nationwide mortgage servicing practices. The proposed agreement provides an estimated $8.4 billion in relief to Florida homeowners and addresses future mortgage loan servicing practices. The settlement generally releases civil claims related to robo-signing, other foreclosure-related abuses, and loan origination misconduct, but it provides no release of criminal claims or of claims related to mortgage securitization. Florida’s share of the total monetary benefits under the settlement is approximately $8.4 billion.

Legislative News: Changes to Personal Injury Protection (PIP) Insurance Coverage

Since 1972, Florida law required that all drivers carry basic personal injury protection (PIP) insurance. PIP provides $10,000 to cover medical bills and lost wages after an accident regardless of who was at fault. The following new conditions now apply to PIP policies and will become effective on July 1, 2012 (medical changes effective January 1, 2013).

The legislation requires an accident victim to obtain treatment within 14 days in an ambulance or hospital, or from a physician, osteopathic physician, chiropractic physician, or dentist.
The full $10,000 PIP medical benefit is available only if a physician, osteopathic physician, dentist, or a supervised physician's assistant or advanced registered nurse practitioner determines that the insured has an "emergency medical condition." If this condition is not met, the PIP medical benefit is limited to $2,500.
An "emergency medical condition" is defined as a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention could reasonably be expected to result in any of the following: (a) Serious jeopardy to patient health (b) Serious impairment to bodily functions (c) Serious dysfunction of any bodily organ or part.
Follow-up services and care requires a referral from a physician, osteopath, chiropractor or dentist. Massage therapy and acupuncture are not eligible PIP benefits.
Examination under oath. If the patient does not show-up, their PIP benefits are eliminated.
Please take note of these changes in the law so that you are educated and aware of the how your mandatory insurance is structured and the benefits that are available to you. Click here for complete bill language and legislative update.

BMW Recalls 1.3 Million Luxury Cars

BMW has issued a recall of approximately 1.3 million vehicles due to an insulated bulkhead connector defect. The positive battery cable in certain 2004-2010 5-Series, 2004-2010 6-Series, 2006-2010 M5, and 2007-2010 M6 vehicles may have been incorrectly attached to the trunk floor panel, which can lead to a loosening of the bolt connection. As it loosens, an increase in electrical resistance at this cable connection is possible and could cause the cable connection to overheat. Overheating could lead to a fire, even while the vehicle is not in use. As a precaution, owners are advised to park outside until the remedy has been made.

The recall is expected to begin sometime in April 2012, and dealers will inspect the vehicle and perform the necessary service free of charge. Owners may contact BMW directly at 1-800-525-7417. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12V126000.

    Yokohama Tire Recall

Yokohama has issued recalls for the following tires: Yokohama replacement tires, size 205/50R16 A680 87V, manufactured between September 1, 2007 and November 28, 2009 and Yokohama tires, size P215/60R15 AVID H4S 93H, manufactured between December 2, 2007, and September 19, 2009. The tires fail to conform to the requirements of Federal Motor Vehicle Safety Standard No. 139, regarding "New Pneumatic Radial Tires for Light Vehicles." Certain tires do not contain the complete Tire Identification Number (TIN) or partial TIN as required. The TIN is important so consumers can properly identify their tires in the event a safety-related performance notice is issued. Diligent attention to tire safety can have life saving value for motorists, and significantly decreases the risk of a crash.

The recall is expected to begin on April 6, 2012, and Yokohama will notify registered owners and provide free replacement tires free of charge. Owners may contact Yokohama directly at 1-888-801-4162. Additional details can also be found by referencing NHTSA CAMPAIGN ID Numbers: 09T014000 or 10T001000.

    GTC Tire Recall

12,000 defective GTC tires have been recalled due to blistering on the sidewall, that over time, can cause tread separation while the vehicle is in operation. Tread separation significantly increases the risk that an operator will lose control of their vehicle and experience catastrophic or fatal injuries. The recall class consists of Advance Extra Grip AR215 light truck radial tires, size P235/75R15, produced from September 2008 through December 2009. These defective tires fail to conform to the requirements of Federal Motor Vehicle Safety Standard No. 139, regarding "New Pneumatic Radial Tires for Light Vehicles.”

The recall is expected to begin sometime in March 2012, and dealers will inspect the vehicle and replace the tires free of charge. Owners may contact GTC directly at 1-330-498-5000. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12T004000.

Lexus Recall – Accelerator Pedal Defect

Toyota has issued a recall of approximately 154,000 Lexus vehicles due to a defect that can cause the accelerator pedal to get stuck while the vehicle is in operation. The pedal in certain 2010 Lexus RX 350 and RX 450 vehicles can get stuck in the wide open position due to its being trapped by an unsecured or incompatible driver’s floor mat. A stuck open accelerator pedal may result in very high vehicle speeds and make it difficult to stop the vehicle, which could increase the risk of a crash and catastrophic injury.

NHTSA Launches Investigation of Chrysler vehicles

The Office of Defects announced today that they are launching an investigation of Chrysler Group LLC's 2009 Dodge Ram 1500 pickup trucks and 2012 Jeep Grand Cherokee vehicles due to potential manufacturing defects.

2012 Jeep Grand Cherokee: Complaints of power steering hose failures that led to severe vehicle hood fires have sparked the investigation. NHTSA said the reports "allege severe fires resulting in total vehicle loss with the cause as yet undetermined."

2009 Dodge Ram: Consumer complaints of rear differential failures resulting in rear wheel lock-up have led to an investigation that could impact approximately 230,000 vehicles.

An ODI investigation provides a preliminary evaluation to assess the cause, scope and frequency of an alleged defect. If sufficient evidence of vehicle defect is detected, an official safety recall will be issued. Vehicle owners should receive notification directly from the manufacturer if a safety recall is issued.

Nissan Recall – Seat Back Failure Defect

Nissan has issued a recall of approximately 11,076 Juke vehicles manufactured from February 2, 2012 through May 26, 2012. Certain 2012 vehicles may contain a manufacturing defect that can cause the rear seat back striker to partially separate during impact. In the event of a crash, an unsecured rear seat back may result in enhanced injuries to passengers.

The recall is expected to begin at the end of July 2012. Dealers have agreed to inspect the vehicle and perform the necessary service free of charge. Owners may contact Nissan directly at 1-800-647-7261. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12V328000.

Honda Recall – Door Latch Auto Defect

Honda has issued a recall of approximately 172,000 CRV and Acura ILX vehicles due to a manufacturing defect that affects the door latch mechanism. In certain 2013 Honda CRV and 2013 Acura ILX vehicles, if the manual or power door lock is activated while an interior front door handle is being operated by an occupant, the cable connecting the interior door handle to the door latch mechanism may become loose and move out of position. There is a possibility that the cable can move far enough out of position to prevent the door from properly latching. If the door is not fully latched, the door may open while driving or upon impact, increasing the risk of catastrophic injury to the vehicle occupants.

The recall is expected to begin on or about August 16, 2012. Dealers have agreed to inspect the vehicle and perform the necessary service free of charge. Owners may contact Honda directly at 1-800-999-1009 and reference safety recall numbers S45/S46/S47. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12V338000.

Ford has issued a recall of approximately 9,320 Escape vehicles manufactured from October 5, 2011 through July 11, 2012, equipped with a 1.6L engine. Certain 2013 vehicles may contain a defect in the compartment fuel line that can lead to a leak. If a leak occurs in the presence of an ignition source, there is an increased risk of a fuel fed fire and/or catastrophic injury.

The recall was expected to begin on July 20, 2012. Dealers have agreed to inspect the vehicle, perform the necessary service free of charge and provide a rental vehicle if needed. Owners may contact Ford directly at 1-866-436-7332 and reference safety recall no. 12S35. Additional details can also be found by referencing NHTSA CAMPAIGN ID Number: 12V336000.

    Ford airbag recalls

My 2009 Mustang has a defective passenger seat occupancy sensor. When no one is seated the airbag flashes code 16. When I fasten the belt on that side still unoccupied, the fault code stops, but the center dash lights up indicating passenger airbag is OFF. My research shows the problem is not unique to my car, and that it has and is an ongoing issue with many cars not just Ford. This vehicle is on the Takata recall for drivers airbag replacement since March of 2015. As yet Ford does not have replacement parts. I believe the passenger seat cushion assembly which includes the bladder, sensor, and ECM should also be recalled. I live in Hawaii (high humidity) and research has shown this to be the root cause of the failures. At this point the vehicle is completely unsafe for the driver and passenger in the event of an accident, the drivers airbag has the potential to cause serious injury or death, and the passenger airbag may or may not deploy or effectively prevent injury or death. Please respond with any direction.
