OD will not disengage under load

My 98 Explorer will not disanage the lockup OD under load. As I push the throttle more, it finally downshifts but with big jerk, and then disengages. However, if I tap the break while pushing the throttle, all is good as the break forces the OD to unlock and down shifting is good. Here is the rest of the info on my track:

1. give the year of manufacture of the truck,
1998
2. if it is 2 or 4 wheel drive,
4 door
3. the type of engine V8 or V6,
V6 SOHC
4. the mileage on the truck,
175k
5. if the transmission has had any work/servicing or rebuilding done to it recently or in the past,
none recently. I transplanted it a year ago replacing one that failed. this one cam from my 97 exp of same type that came from used parts with estimated 80k.
6. the specific problem symptoms,
as described at the top: will not disengage OD lockup under load.
7. the specific OBD I or OBD II DTC codes it is putting out and to try and get a FORD NGS or FORD ROTUNDA scan tool to get these codes,
did not lookup the codes yet. no engine light (I know, a code may be there.. i'll check later this weekend)
8. if you have checked the fluid level in the trannie
Yes, is good and is only about 10k old (since a hear ago)
9. and it's color
color blind! but I'l ask...
10. and when was the last time you changed the ATF and the filter
a year ago, ~10k ago
11. and what type of fluid you used
cannot remember, but it was the correct one. not my first time!
12. and if you have any ATF fluid leaks under your truck when parked.
no leaks
13. any recent electrical problems, wiring problems
none
14. any engine running roughly problems and repairs made recently. Many sensors on these trucks that PCM uses to control the trannie.
had some misses but fixed that with new SP wires.
15. state any modifications made to the engine, drivetrain, oversized rims/tires, etc.
none. all stack.
16. state under what conditions when the transmission started to act up/failed to shift, while off-roading, towing, extreme weather conditions, etc.
only once in OD and under increased load: uphill or increased throttle.
