My issue DID end up being a heat sheild. It was the one that surrounds the transfer case. I swore it was my TQ, but I ws wrong. The loose sheild is easy to miss. It took a lot of force to move it and see the crack where it was reattling.

Unfortunately your tranny is sealed. You can't check the fluid. There is a procedure on how to do it. I dont have the link, but if you search "how to check tranny fluid" you should find it.

Yeah it definitely sounds like a flow/pressure type deal to me. It seems to work fine though so I am not too concerned. I will report back if I ever find the cause or solution.

The maybe 3-5 HP gain will be negated by the lost low end torque. I am not a fan of CAI's on stock vehicles. They do more harm them good IMO. But they sound cool.
