1999 explorer auto four wheel drive won't disengage

My 99 explorer has auto 4 wheel drive n when in engages on a patch of ice it won't disengage I've tried unhooking the battery n driving in reverse n its stays engaged n in bout a day or 2 of driving it it decides to disengage n work fine till it engages again I just recently replaced my c.v axles ne advice will be greatly appreciated thank you

Does it bind and pop?
 






If I have to turn hard it does but going around a regular corner it don't pop or grind n when it's engaged when I slow down there's a whining sound when its disengaged there's no whining
 






ABS light on?
 






Nope only light. On is the battery light n that's been on since the day I bought it almost 2 years ago n I ve put a new battery in it
 






How long has it been (if ever) since the transfer case fluid has been changed? I fear you may be seeing the early stages of a failing t-case. Mine did this a couple years ago and resulted in having to have it rebuilt.
 






I honestly don't know I've only owned it for bout two years I had to replace the c.v's cuz they where popping n grinding it don't do it with the new ones when its not engaged till I slips n engages the for wheel drive its disengaged the last time it engaged on a patch of ice n disengaged a couple days later
 






I'd certainly start with a fluid change...and, remove/clean the ends of the two Halls sensors mounted on the transfer case while you're at it. Here's an interesting read on how your Borg Warner 4405 t-case operates that might lend a clue if a fluid change doesn't help:

I just drove my explorer to the gas station n the front end is disengaged again
