Fighting A Speeding Ticket in MA

know how to make it so your insurance company finds out?

pay the ticket. dont take it to court. pay it.

tell the cop that you will mail the check in.

write a check for $210

they will send you a $6 rebate check.

dont cash the check, and the insurance company never finds out. well, at least they didnt find out about when my neighbor got a ticket.

Chase's advice is right on the money. The best way to do it is the speed limit signs themselves. The size and height, even placement and spacing of a speed limit sign is all mandated federally, and jurisdictions MUST have EVERY speed limit sign inspected by a federal authority before it can be enforced legally. The size must be uniform, as must be the height and visibility, and there also must be a research study done on EACH SIGN as to its neccesity and what limit it reads. All you have to do is ask the court to see the study results and all said documents, and if they cannot produce them, they HAVE to throw out the case. Truth is, they hardly ever do all the crap the feds ask of them, so almost every speeding ticket you get is given to you illegally anyway!

Another great trick is to go up to the officer right before the session begins and ask him to see his credentials and registration in the snottyest way you can, he'll laugh and say no and you'll have him in contempt. Best part is when the judge laughs too, then you can appeal and find the whole damn thing in mistrial.

Traffic cops and traffic courts are REALLY REALLY stupid on the whole...

In NC, your ticket becomes public record. Within a few days of being pulled, you will many letters from lawyers in the area asking to take care of the ticket. The lawyer fees were anywhere from $75 to $200. I got one for $100, he went to court and pled improper equipment (whatever that means). All I had to pay were court costs and a reduced fine.

I had a lawyer for my trial, but that's only because I was 16. There are some judges in Atlanta who won't even listen to the case, they'll just say that in their opinion, 16 is too young to drive, and they'll take your license away until you're 18. I only had a lawyer to make sure that didn't happen. Other than that, I don't think lawyers are necessary. Just do a little research and find out what you can do on your own.
 






True, most of the time they are not necessary. But where I live, its a racket. You can't show up to court and plead 'improper equipment' and get off. The lawyer takes your money, moves your trial to his 'favorite' judge, then gets you off.
 






I think one thing some people are overlooking is diplomacy. Just by being a nice guy and kissing some ass and having a good story, I got it reduced nearly 10mph... Then I went to court wiht a lawyer, and got it reduced to a weak fine with no points... And I did it without making a fool of the cop or challenging him... that way.. the next time he sees a green limited explorer by the highschool, he wont throw the book at me.

Yes, that is also right. But you can't depend on diplomacy to get you everywhere. You have to be diplomatic while employing all the other creative methods listed above

Diplomacy is being able to say nice doggy until you can find a large enough rock.
 






Good news, maybe, or well better than none at all

Ok so I told my boss about my ticket today, the one who made me late, the whole reason I was speeding. So he asks me where I got it, I said princeton, he responds you should've called me I know plenty of people in princeton. I said oh yeah, like who, I know one retired sargent, another current sargent, the officer in charge of drug something or other, and the dispatcher works for him at the state park he manages, who he just saved from getting fired. He then proceeds to tell me that I could've also called about 3 other people I work with to get it taken care of. Odds are it's already been processed. But my boss is going to make some phone calls for me tommorow. Anyone know if it can get taken care of after the stae has the ticket? So anyways I guess thats pretty good news.
 






Man, that's a bummer to find that out after they process the ticket. Unless he knows someone really high up, I wouldn't imagine that there's much you can do after the state's got it. But actually, you might want to check on if they process it with the state. In Georgia they process it to the county, where it's still possible for the ticket to mysteriously disappear before the county has time to file it with the state. There might be a middle step like that in Massachussetts too, I dunno
 






I'm hoping someone can "lose" the ticket, or perhaps the officer will fail to show up. My boss is also a manager of a state park, so he works for the state and knows alot of people, so I guess I have to just cross my fingers
 






Well good luck. Do you have your court date? In Massachussetts, do you get to choose a date or is it assigned to you?
 






My ticket hasn't even been sent in, I have 20 days to pay, or arrange for a court date. It's only been about 5 so far. There's no spot on the ticket for requesting the court date, so I'm assuming it's assigned. I'm planning on waiting to send it in untill I talk to my boss. I'm pretty sure processed just means sent to the archives, I don't think it can be technicaly processed untill I send in my ticket with money or asking for a court date. I know my friend had his ticket "lost" in the archives, so perhaps that can be arranged.

get a lawyer and have him deal with the cop. according to the cop that pulled me over i was doing 80 into 65 (i was only going 75... i'll admit that). anyway, i got a lawyer and got it reduced to a 10-11A which is a failure to obey a traffic control device. $75 fine and $250 for the lawyer. well worth it in my book. insurance would have killed me if i had got the speeding ticket. i will most likely see a little increase in my premium when i renew but nothing compared to what it could have been. My boss said that what's going to happen, is I'm going to file for a court date, and when the officer shows up, he's going to say he didn't calibrate the radar, and the magistrate will probably yell at me for a while, and then drop the charge. This is assuming the officer isn't an @ss hole, but my boss doesn't yet, but he said thats what should happen. so I guess wish me luck

That's kind of like what happened to me in a way. I got the charges dropped, got a lecture about safe driving, and was free to go.

Well it's been a while, and tommorow is my court date, my first connection was a no go, I guess the two cops didn't get along. But my EMT instructor happens to be best friends with the cops brother, who happened to pull me over, not to mention me EMT instructors father is the police chief in the town I got pulled over. Unfortunately as of this afternoon he hasn't been able to get in contact with the cop that pulled me over. So I think I'm just going to say:
"This is my first speeding ticket, I've had my lisence for almost 2 years, and my record is flawless. I honestly did not believe that I was traveling that much in excess of the speed limit. I work at the local ski mountain as an EMT, and I got out of work an hour and a half late, my three dogs had been inside the house all day, and I really needed to get hom to take care of them."
And well thats all I have. I may see if I can get a mechanic to write me a recipt saying my spedometer was off by so many miles, and that he fixed it.
I realize it is a pretty weak plan, but in Massachusetts, you don't really get a trial, or the ability to bargin, just a clerk magistrate. Well I am at the mercy of the courts, wish me luck.
