You likely have a broken intermediate band.

can i put a 4r or 5r in it? its just a trail beater so i dont care if it shifts hard or anything

No they are electronic and you lack the pcm to command them

Welcome to this forum! It sounds most likely that your intermediate band is broken as Glacier991 previously stated. You could try to adjust the intermediate band to confirm this theory. If the adjusting stud keeps tightening without stopping, then you will know that the band is broken. If it does tighten up to 120 In/Lbs, then back it off 2 turns, and see how it drives. If it still doesn't go into 2nd gear, then your servo piston could be rotted out. The governor could also be stuck if this happens when it's cold, but goes away when it warms up. Check the modulator's vacuum line for leaking ATF if you have problems in other gears as well.

i checked the modulator and that was fine, it doesnt matter if its warm or cold it still goes from first to third, and which band is the intermediate band i looked on the side of the tranny and there are two band adjusters. which one do i check. also if its not the band how do i check the servo

The servos are very difficult to remove while the transmission is still on the vehicle. You could get to them in two ways. The first way would be to remove the front seats, pull back the carpet, and remove the access panel in the floor. The second way would be to remove the catalytic converter.

The intermediate band is located in the middle of the transmission. The overdrive band is the first one which is near the bellhousing.

looks like it was broken intermediate band, adjusted it all the way in and it never stopped, looks like i need to find a new tranny for it. thanks for all the help guys, its nice to know there are explorer gods out there.
