Hi everyone,

Anyone know how I can sell my exploder in Mass when it failed inspection & needs repairs & rust fixed???

My 97 exploder 2-door sport 6cyl 4.0 is on it's way out. It's got 107,000mi (which isn't a lot). I've owned it for 11 yrs and it just failed a Massachusetts state inspection. Rocker panels are rotted away under the doors, needs a new muffler, engine light is on (likely due to faulty gas cap & cracked filler insert), needs rear brake pads and rotors, ABS is acting up so it's unplugged for now. Other then that, it runs great and it looks excellent inside.

NOW WHAT?! I'm buying another used vehicle from a family member.
I don't need my exploder anymore and obviously won't be trading it in toward anything. I thought about selling it on craigslist BUT:

In Massachusetts, the lemon law protects buyers from vehicles like mine that won't pass inspection.
I'm told I could sell "as is" but technically, the buyer is protected and can find me responsible for all repairs (that cost at least 10% of the cost of the vehicle) to pass inspection, even if I disclose all of it in the bill of sale. I'm also told by consumer affairs that there's no such thing as a "parts" car (I asked if I could sell for parts). Same Lemon Law applies.

So, basically I can't sell it now without being responsible for the repairs???
I'm sure someone out there wouldn't mind buying it REAL CHEAP for a project or parts, even though it runs.

PLEASE HELP! NEED ADVISE ~ Is there a way for me to sell it and not be responsible for repairs???? I wouldn't mind making a few bucks on it before I let it go. If it's too much of a risk to sell it, then I'll probably scrap it. Don't have time to mess with parting it out.

Have you thought about selling it as a "parts car"? It might get you out from under the liabilities...

I thought of that. Was gonna sell it as a "parts car" & "as is" with full disclosure to the buyer. I asked consumer affairs if I could just sell my car as a "parts car" and they basically told me there's no such thing in the eye of the law in Mass as far as the lemon law goes. :rolleyes: Not sure I competely understand that.
I know folks do it all the time. Just trying to figure out how to protect myself (if it's even worth the effort). Seems to me if you right up a bill of sale with "as is" & "sold for parts" and the buyer agrees & understands, then I don't see the buyer running out to get that state inspection sticker within the required 7 days, knowing it won't pass just so he can ask for his $ back from me :rolleyes:

2nd option is for me dump $$ into it to replace the exhaust system, fix ABS issue (not sure if it's just a sensor yet), slap on some panels to repair rocker rust, fix gas cap/filler insert issue, replace rear pads & possibly rotors and I'd have a better vehicle to sell with less liability as far as the lemon law goes.

I could do most of the work myself to save some $, and maybe it's the difference between selling it for $700 and selling it for $1500. Worth it?

Either way, how do I sell this thing and still protect myself from the lemon law?

LOL Evidently, you CAN sell a vehicle "as is" as a "parts car". Nobody in their right mind buys a used vehicle (with full disclosure of repairs needed & told it won't pass inspection), just to turn around and ask for their money back. Why bother buying it then, right?
 






Ebay it, it's nation wide advertising.

Sell the vehicle as is, get a signed note that it's sold in "As Is Condition" and you "The Seller" is not responsible for any inspection related repairs.

Put a note on the auction that the vehicle is NOT for sale to anybody in the state of Mass. due to inspection issues. That will protect you.

You'll sell it pretty quick that way, just be totally honest, TAKE A LOT OF DETAILED PICTURES, price it right or let it fly with no reserve. Ebay lets you put a lot of pics up for free. Let the people looking at your vehicle see everything. Door panels, inside and out, the rust, front, rear, sides, interior, dash and engine compartment. Write a DETAILED description about the vehicle including everything you know that's wrong with it and why you cannot sell it in Mass.

Good luck, should be an easy task.
I Ebay cars all the time for friends and clients. Never had an issue.
