Anyone with experience with keeping a car that the insurance company has totaled?

Why would an insurance company give you the option of deciding whether or not they should go after the other insurance company for reimbursement of monies given to you as settlement rather than automatically doing so for their own benefit?

I didn't think so. Was just asking because of what Sigmo said was told to him by his insurance company. Were they inferring he could go after the other driver's insurance company on his own if he wanted...rather than run it thru his own insurance company? But, again...why would someone want to bother with it when the two insurance companies could settle it between them?

What if he didn't have collision coverage? He'd be on his own. And you can't even afford to hire an attorney, unless you were to be injured and the attorney was nice enough to roll the damage to the car into the bodily injury claim.
