Well, the last two weeks have been a real roller coaster ride. My mother who was visiting from Georgia who I hadn't seen in three years had a heart attack a few days after being here. Guess the excitement and fun was too much. After dropping my father in law off at the hotel, I was heading back home and started smelling something burning. I pulled over to the closest shop I could find which was a tranny shop. We determined that the caliper seized on the right side. After discussing fixing it and finding out that the master cylinder was bad, he told me that there was a possibility that some switch((can't remember the name of the switch) could also be bad which could cost around $200 extra dollars which would have put the truck around $500 - $600 to fix - this is what he told me. I told him to not fix a thing, and THEN he popped the question if I want to sell the truck and for how much. I said that I hate to keep putting money into it, and so I'd sell it to him for $600.00. He told me that he'd get the money in a couple of days. Well, I wasn't able to get back to his shop within two days and with my kid having autism and my mom being in the hospital with 50% of her heart damaged, I wasn't thinking too straight. I mean, I've been sorta wishy washy about holding on to my truck, but it's probably cause I really loved driving it and working on it the little that I did.
Well, I called and told the guy at the shop that I had second thoughts about selling it and that I didn't want to sell it. This was like Winney the Pooh in the honey tree and I started some fireworks. He basically told me that it was his truck now because of my verbal contract commitment and that he had done $700.00 worth of work on the front end. I was a little shocked to hear this and to see that my truck now had a for sale sign for $2500.00 on it. He started telling me how he would win in court if it went that far and then acted like he was going to call the police. I had not even signed the title to this guy, and it really chapped my hide that he went and did the work when the truck had not been signed over to him. I left the shop and called the police just to find out how the law would be here in New Mexico. The officer told me that it was a verbal contract and that I would either have to pay for the work or sign the title to him. I accepted this response because I realized that I did say that I would sell the truck to him for $600.00, so I kept my word and went and released the truck to him. At least he did give me an extra $200 for it.
Why am I telling you all this? Because I want to warn you that although the law is on his side, what he did I feel is morally wrong and he should NOT have done the work without receiving the title. People are apt to change their minds at times in life and sometimes open their mouths before engaging the brain (especially in my circumstances and stress). He should have let my truck sit until he had the title. Unfortunately, God is more forgiving than people are and God will let you off the hook when a human being will look for a weight to send you down to the bottom of the ocean in order to get something they want. I can't say for sure, but it is possible that since he knows the law is on his side in this type scenario, it is possible that he has pulled this tactic on other people, which if he has, that is wrong and a shame that the law would let something like this go on. Hopefully, this is not the case, but be warned guys to not commit to anything regarding your truck unless you know for certain that this is what you want to do. I could have paid him for the work and kept the truck, however, I wanted to keep my word despite someone's lack of grace and what I perceive to be greed and an easy buck. Bottom line is I blew it. Don't make my mistake. Be sure before you say anything.
I'll miss my Explorer. Thanks to you guys for the expert information here and those who have responded to my posts with help. I wish all you guys well, and maybe in a few years, I'll get another Exploder that I can call my own again. Most likely my twins will end up driving it more than me since they'll be reaching 16 in a couple of years.
