It won't be loader if it's after the muffler. It might be only slightly because the outlet will be closer to the cabin.
If he cuts off after the muffler it will be louder, b/c he is removing all of the bends which make it more quiet.
 






If you have "inspections" that actually check exhaust setups, it will probably fail (like you said, ask a cop/inspector to be certain). In most states that check such things (like VA), the tailpipe has to go beyond the rear door.

edit: yes, it will be louder. I have had rust holes quite far past the muffler, and you could hear the difference. I can't even imagine a hacked pipe just beyond a FM40, the sound/resinance from such a setup should be the equivalent to Chinesse water torture. :D
 






I just put a Flowmaster 40 on my X as a matter of fact. It has a nice rumble to it now, but I want the LOUDNESS. If I were to dump my exhaust, how much louder will it make it? Does it sound good?

Yah like that! How loud does that make your 4.0? Do you get any fumes in the cabin with that setup?
 






It's a pic of mine. It's loud at idle and WOT. They're Deltaflows though, so in the end I wish I would have just got the regulars 40s.

Nope, but Im saving up right now for the Super 40s and gonna put them out back.
 












Just to update whether or not it is legal, when i called the inspector he seemed a little unsure of an answer. He said on an SUV the exhaust needs to exit in the back of the vehicle but then i asked about if it were to come out the side before the rear tire. His answer: he knows its legal on trucks, but isnt entirely sure on SUVs. He gave me a number to call (closed on sundays) so i will call the makers of the laws tomorrow. If it is illegal im thinking that i can make it where i can just clamp on and off my current pipe and the turn down.
 






Well I cut the pipe yesterday about 5 inches back from the muffler. It's noticably louder and a bit faster. I cut it about half an inch behind the rear passenger door and am going to put a turn down tip on it.
