Gearbox problem oil or clutch?

Hi, just need some advice on checking transmission fluid...do i need to do this in drive or neutral.
Also gearbox seems to be kicking down when changing up from 2nd to 3rd.
It stays in second longer than usual then revs high for a second then engages 3rd, please help.
