Well, PA doesn't have a specific "exhibition of speed law". Careless disregard for the safety of persons is what the law you were charged with says. It will be up to the officer to prove that you operated with that careless disregard. If the citation states specifically on the citation that you accelerated over the speed limit at night, then you have a court case. Really the more applicable section in this case would be driving vehicle at safe speed. I'm no insurance expert but I believe Careless Driving looks worse than Driving Vehicle at Safe Speed. As well as a one point difference, Careless carries 3 points, DVaSS is 2 points.

Just because the stop was audibly and visually recorded doesn't mean the violation was.

If you do choose to proceed with court, you could ask for a deal. Have the officer amend the citation to DVaSS/2pts versus what you have and plea to that OR just go ahead and state the facts about the case in front of the MDJ and take what you get.

If the officer doesn't have the video then state it must be convenient for it to be missing as the officer was emphatic that you were on both audio and video..

In PA because of all the archaic laws surrounding audio/visual recording and wiretapping, even being on a traffic stop an officer should state to you that you are being audibly and visually recorded. If nothing else take it as a friendly warning not to act up or make false accusations if it comes to that. It doesn't necessarily mean that the violation was recorded, some systems will record prior to the officer activating the emergency lights/siren some wont.. Different agencies use different equipment.

Understood, but I think it would look in you favor if you ask to see the incriminating evidence and their isn't any. In the not too distant future everything will be recorded; This IMO would help many people get out of questionable tickets when the offense is at the officer's discretion. And for those who actually break the law the recording will ensure they are fairly punished.

I fully agree, no way around honesty then. I would be quite happy about that as it would virtually put an end to false complaints against officers as well. At the end of the day however would it take away discretion? Could that warning that would be normally be written turn into a citation for fear of a supervisor viewing the tape and seeing too much leniency.

I'm getting off topic here though, I'll say good luck to the OP, you have a good chance to get a break or a dismissal. :)
 






alright get this i went to get gas one night at the qt by my house and on my way back i see that loganville pd has someone pulled over at a red light. i thought nothing of it so i made a left at the light and go home. twenty minutes later i hear pounding at my door. it was the same cop that had someone pulled over. he tells me that i turned in front of someone and took off speeding down the road. my 91 ex is straight piped which makes it sound like i'm speeding. so anyways he writes me a ticket for wreckless driving and speeding and excessivly loud exhaust.
 






Sounds about right coming from Georgia!! I lived in Alabama for 10 years and had a couple run-ins with Georgia,Alabama and Florida police.
 






im 18 now and ive been pulled over 3 times already-i have lead-foot-itis the first time was deserved because i was in my 86 maxima with exhaust and intake.. needless to say i let er' rip right in front of a cop----PULLED 64 in a 45 i did driving school and dropped

second time.
i was in my mothers 03 EX drivin it to autozone to get oil change supplies..the cop follows me for a mileand im doing the speed limit and WOOP WOOP -her registration expired.... i had "gone country" playin on the radio when he came up to the window and he was very cool i told him it wasnt mine and i could call my dad and ask him whats up with the registration... he said naw its alright just let him know about it...

this next cop was by far the coolest one out of all of them
i was on my way to pick up the girlfriends little sister so we could go get her from the airport and i was so exited----well i was rollin through a neighborhood main road when i came around the corner and WOAH **** he was there....i knew id been had-so i pulled over and he didnt even use his siren... i was doing 54 in a 35 (same speed over as first -19) and we got to talking... i was about to be 18 and he said "alright son, im not gonna mess you up before your 18 you just need to think about what your doin"..he glanced at my inspection sticker, i said thank you very much sir and i started her up AFTER he got in his car...... i think around here our cops dont like ricers, and are country biased lol because my mountaineer had OPEN HEADERS, NO FRONT LICENSE PLATE, AND AN UNCOVERED ROOF RACK LIGHT BAR

at least around here our police do a good job-:thumbsup: might be different if you are rice!!! ha
 






I Got pulled over the other day for a loud exhaust. Cop just gave me a warning luckly. Get to where I was going and look at the warning. He gave me a warning for No or Inadequate Muffler for my silver trailer. Its my jet ski trailer that I didnt even think about having the registration for in my truck because I just got the ski. I'm thinking that he just pulled me over to find more things to cite me for. So now I have to go put a darn muffler on my ski trailer.
 






You'd better get right on that, lol. I wonder what size is adequate for a 0cc engine?

I wish cops around here were more into giving warnings. I've been pulled over 4 time (although it's been 6 years now since the last, knock on wood). The only time I ever got a warning instead of a ticket was when a cop cut me off at 5:00 am. Literally changed into my lane with less then 5 feet between our bumpers shortly after we had pulled away from a light. There were no cars in front of us, he had no reason to be that close. So I followed him, without letting the gap change. We got up to the speed limit and stayed right at it. A few blocks later he pulls into a parking lot, lets me pass, then pulls behind me and pulls me over. I was expecting some sort of BS about tail gating, to which I would have replied that I didn't get that close to him, he cut me off. But instead he starts rambling about how he was speeding, but he has important things to do, and I shouldn't have been speeding just because he was, etc. I was like WTF! But he let me off with just a warning. I think his shift changed 30 min. later and he was just tired and actin a fool.

about a month ago i got pulled over for no front plate and the cop said that my trailer hitch was blocking my rear plate ( it was blocking it alittle but u can still read it..). this was the first time i have got pulled over (knock on wood). the cop let me go with a warning and ask where i was going. the cop was really cool to me and just said to get a front plate and remove the trailer hitch when i dont have a trail hooked on.

Cuffed and taken in for not using my turn signal. 5 am going to work, all alone at a light. Cop across the street saw me turn right w/out signal. 2 minutes after that 4 cops surround me and pull me out and cuff me. Turns out 8 months earlier when i moved to chicago, my florida license was turned in and was put in the computer as forfeited. According to il. a forfeit is a suspension when in florida it means it was returned to the issuing state. Spent the day getting my prints done and mug shot taken and car impounded. needless to say it was all a simple misunderstanding, after i paid my $300.

that really stinks man... when my brother got tboned by some lady who was backing up in an intersection and the cop almost gave him a ticket for "swooping" in an intersection. swooping? wtf?

I was pulled over a few years back for doing 78 in a 55. I was on a two lane, two way highway between Mitchell Indiana and Orleans Indiana. I was on my way back to Bloomington because I could not locate the house I needed to find to do my job that night so after driving around the countryside for two hours I headed home.

I was only keeping up with traffic, I was not passing everyone in my way because I was not in a hurry to be honest. I was in a 1999 Chevy mailbu, quad four and it has the get up and go. (Once beat a 96 mustang GT, Oh yeah I raced it). But that night was different for some reason.

The state police officer was heading south as I was heading north, he of course turned around to pull me over. It took me a mile or two before I found a safe looking well lighted location for both mine and his safety.

First thing he said was, "Do you know why I pulled you over?" I stated I had no idea because I didn't really know. then he starts complaining that I should have pulled over sooner. I told him I was looking for a safe location that had lighting because it was dark and I had done that for mine and his safety, and I ask if he wanted me to pull over in the right lane of that two lane highway.

He stated he wanted me to pull over when he turned his lights on because I don't have a choice of the location but rather where ever he wanted me to pull over at. Then he mumbled something about AAA because I had a AAA sticker on the bumper. (Was there when I got the car, Personally I can change my own tire).

Afterwords he takes my information and comes back to hand me the ticket which was for 78 in a 55. Then we went on our way.

But after which I contacted the courthouse that should have had that ticket 20 days after the fact and they didn't have it and said they would make a note to contact me once they receive it. I got a letter from the BMV 12 months later and was forced to leave work early one day to pay it before I had my DL suspended.

I paid the ticket because I was speeding, I had to take a defensive driving which cost about $50. I was pulled over recently and got a ticket because the points that should have been removed for taking the course were still there :(

I dislike the BMV now :(
