too much fluid in transfer case?

Seemed like the front driveshaft was sticking in my Explorer, so last night my brother and I were going to just drain and refill it. Well come to find out that when I pull the fill plug there's about 1/2 to 1 qt of transmission fluid that drained. Granted the rear is slightly lower than the front, but not that much. The fluid looked pretty good, a little dark, but not terrible. Just wondering if it had possibly been overfilled by the transmission shop when I had the tranny rebuilt?

Would it be possible to get a reply before I get off work? Could that have happened? Or do I need to take it back to them for the warranty because I've got a leak between components?
 












I figured a little is ok, but it lost a lot more than I thought it should when it was sitting like that. Since I drained that out it has stopped locking up so bad, but it still sounds like it's having a hard time disengaging the rear end at times. I don't know if it's because of the locker or what, but I hear a clunk usually after I let off the gas. I just checked the transmission fluid, looked a little low so I added a quart. I'm sure I lost a bit when I put on the transmission cooler. Figured that might be it, haven't had a chance to test drive again since that, but I'll check later and hopefully be back with good news.
 






Seems to have helped a bit, still get a bit of a clunk, my guess now is that it's driveline bind up from the locker and it's unloading. It's a lot less abrupt now, but I can still tell. But I know the fluid levels are correct.
