Ford ordered to pay $14.5 million over Explorer accident

December 7, 1999

BY WILLIAM MCQUILLEN
BLOOMBERG

CHICAGO -- Ford Motor Co., the world's No. 2 automaker, was told by a Chicago jury last month to pay $14 million to a woman who was injured when the 1991 Explorer she drove was rear-ended.

Ford will ask the court to set aside the verdict and plans to appeal the state court jury's decision, said Mark Boyle, an attorney representing Ford. The jury ordered the automaker to pay another $500,000 to Lydia Carrillo's husband Angelo stemming from the 1993 accident.

Carrillo's vehicle was stopped at a red light when a 1980 Chevrolet Impala hit it at a speed of 60 to 65 miles an hour, Boyle said. The jury decided the Explorer's front seats were not strong enough to withstand the impact of the collision.

Boyle said the vehicle's seats met all safety requirements.

"With the nature of the accident, risks of serious injury existed," Boyle said. "(When) hit at 60 to 65 miles per hour, there are risks of injury regardless of seat and seat design."

The jury found Ford 30 percent responsible for the accident, and Kevin Gaczkowski, the driver of the Impala, 70 percent liable. Illinois laws will make Ford responsible for the entire verdict, Boyle said.

The award is the latest in a string of product liability jury verdicts against the major automakers.

In September, Ford won the right to a new trial on a California jury's award of $295 million for a 1993 rollover of a Bronco that killed a couple and their teenage son near Modesto, California

Jack Lobdell had his drivers seat break free when he was rearended at a relatively high speed.

I found cracks in my mounting rail when I changed from my stock seats to the Ranger STX seats which I have now. The cracks were right where the mount angles upward just behind the bolt.

I wonder how many others have cracks like that, but don't know it?

I had a friend of mine died this way in a wreck. He was in a new 4Runner (stopped in traffic on the I-75) when he got smacked by a @$%& tractor trailer going to fast. It hit my friends 4Runner, knocked it out of the way then hit a van crushing it against the next tractor trailer. (more details but leaving them out). Anyway, when I went to look at the 4Runner, his seat back broke knocking him ALL the way in the back.

Just had to vent it out!!!!

I have a 91 XLT and my driver's seat is just about shot. The seat cushion foam is worn out and flaking, and the seat back is fatigued to the point that it leans back too far, even at the most vertical setting. I looked into rebuilding the stock seat but quickly figured that I shouldn't put any more money into something I really didn't like anyway. I've been looking at many different aftermarket brands including Recaro, Momo, Cobra, Sparco, and Corbeau. The Corbeau's are the most affordable of the bunch, while the rest can get quite expensive.

After reading this post by KyleC and seeing that Rick and Jack had problems, I'm glad that I decided to replace my stock seats instead of bebuild them.

Has anyone else had any experience with aftermarket seats? Also, has anyone had any experience with the one-piece, non-reclining race buckets that many of the above manufacturers produce? I know these are the safest seats to get, that's why race vehicles use them. They sure look cool too. They are also less expensive than the reclining versions. But I am wondering about comfort in an Explorer application. If anyone has any experience at all with this type of seat, I would very much apprecieate their opinions.

Though we had new news for a sec.

Yeah, mine broke too. If you continue to search you'll find how to do it. Not too hard, although I haven't actually done it.

Fordparts.com has it I believe?
