New Member :) - Need Some Help :(

I just bought a '97 Mountaineer with 140K from a dealer in Mass. I love Fords, I've owned 2 SHOs and am an active member on the Taurus SHO Forum and we've got an F-250, F-150, and 01 Mustang GT.

When I first brought the car home, the CE light came on. I brought it back to him because under the Lemon Laws.. you know. Guy said he'd fix everything to get it a sticker and had the EGR valve replaced. Two days later, picked up the truck but then it failed for a bad cat, left front ball joints, and a bad e-brake shoe. In Mass, there's a law that you actually can return a vehicle if it fails inspection and the repairs needed is more than 10% of what I paid. I asked him for a refund and basically, this guy is being an a** and said if I want my money back, I'll have to see him in court.

It's not that I'm not capable of doing the work, I've just found after driving it for a little while that an SUV is not for me. If anyone is interested in it or trade me for a car, let me know. For some reason, it won't let me post in the For Sale section. I don't know if there are any fees for this site, I can't seem to find any Stickies saying that.

Anything with 140k, that's the chance you take. That said, if the laws in your state say you can return it for a refund and the dealer won't, I would take him to court just to be an a** right back. But that's the kind of guy I am. Look at it this way, if you sell it could the buyer do the same thing to you?

Ya I am aware of all my options. I just figured of all people who'd maybe consider a great parts car or winter beater, this would be the place to first offer it to. I know some people are devoted to these trucks as I am to SHOs, but I'll look into the Elite option.

For taking him to court, he threatened this to me but he is right that I will waste more time and money taking him to court then selling it to someone. I honestly just want it gone. I didn't pay too much for it and I'm in college and don't have the time and financial resources to waste any more money for an attorney.

You don't need to spend money to sue him. Take it to small claims, most will allow up to a $2,500 dispute. And also remember, when you sue someone and win you are entitled to 3x's the money lost, it's some latin word that sounds like "trouble" any lawyer can tell you the same thing. So a Small Claims Court can award you up to $7,500. Also file a complaint with your States Attorney General, they will prosecute him free for you.

Oh, and Small Claims Court is free to you, it will cost him when he loses the case.
