no secondary cats= failed inspection?

Guys, I was wondering if I were to remove the secondary cats on my 97 explorer (5.0), if i would fail inspection for emissions? I am wanting to change to a performance 2 into 1 muffler, and want to do away with the secondary cats, but want to make sure it would still pass inspection. Anyone have any idea?

The cats are split up into different stages, you need all of them to work properly. You can remove all of them and install a single aftermarket cat as all the stages are combined in one unit. The only thing you will gain is sound. As far as visual it's up to the person who inspects it, they don't even look under my rig or open the hood here.
 






I'd say its too much work and risk for very little or no benefits.
 












So, keeping the stock cats is probably best. How about going to a performance muffler like a dynomax. I'm still running the stock manifolds, and probably will be for a while. Any gain in throttle response or low end going with say a dynomax turbo muffler over the stock muffler? BTW, I'd like to keep things as quiet as possible.
