Selling my vehicle - Questions on process

Hey fellas,

Let me start off by saying I was unable to find a better suited forum for this (except maybe in the forum for a 2003 explorer, but I figured I'm a little more known in this forum, and it's indifferent as to the type of vehicle for this questioN)

Ok - So I'm looking to sell my 2003 Explorer, but don't know what will need to be done. Here's the situation-

We initiated the loan in my father's name, where it stayed, until it was paid off about a month ago. So after the last payment was made, they signed the title over to him. So as it stands, there is the lien holder's name, along with their signature to give him the title.

At this point, it is a Texas Title in my dad's name, and I live in Colorado. Also, it has Colorado Plates on it at this time (can't remember if the power of attorney let me register to my name, or his). If I wanted to sell the vehicle today, how would I do so. Will it be as simple as me signing the title to the new person? Even though it states my father's name?

Maybe someone here will be familiar with the process and can shed some light as to what needs to happen.

As long as the title has been signed off from the bank all you have to do is write up a bill of sale (you can google and download a blank one from the internet) and then just have your dad sign the title under the seller section and you are done. Probably be best if you just mailed the title to him, have him sign the sale signature but leave the date and everything else blank, and then mail it back to you so you will be prepared when someone brings you the money.

I do still have a valid power of attorney which states that I can 'Register or Transfer Ownership' for this vehicle, in my dad's name. Does that mean I can sign the title? Or does it FOR SURE need to be signed by him?

Also, will the bill of sale need to have my dad's name/signature, or can it have mine?



One last question - the fella requested that I write up the bill of sale for a less amount than what I sell it for so it will be cheaper for him at the DMV. Would there be any kind of repercussion for doing so? Do I miss out or lose out on anything by doing that? I'll still be getting paid the full amount of what we agreed on, but will be writing the bill of sale to indicate differently.

Sorry I missed your other questions! Been in San Antonio for work last week. Guess you got it all worked out, but just to answer, yeah you are good to sign if you have POA, and fine on making the amt less on the BOS. Just makes less taxes for him to pay at the DMV. Glad ya got it handled, and can't wait to see what ya do!
