I'M GETTING SUED!!

This really sucks I'm getting sued for an aciident that happend last year. It was berryly a fender bender and we both drove away. Now i getting sued for $25,000 bucks. Just because there marrige has gone down hill. Any advice? Please?

Putting a hit on someone is cheaper than 25k.. usually. :D (Especially in L.A.)
 






Get a good lawyer. If you were not at fault, consider counter-suing.
 












What is the basis for their lawsuit?
 






Was the accident settled with your insurance companies? Was any damage fixed?

What is the basis of the suit? Are they suing to get medical bills taken care of? Also, there may be a statute of limitations on this if it took place more than a year ago.

Like was said before, get an attorney to look at the suit and see if it has any merit and get in touch with your insurance company, they may be able to help with this and they have deeper pockets.

Just my opinion. It seems kind of shady that they would take this long to come after you.

There is no possible way in the courts view and law's that they would be successful in suing you b/c there marriage fell apart or whatever. The people suing you are friggen morons and now they opened an easy position for you to sue them.

If they bring the suit, you will be able to easy counter-sue them for the amount they were suing you for plus any just compensation you add on ;) . They opened a can of whup-azz on themselves.

I know this b/c I have a Business Law class right now college, and my teacher is a lawyer and uses examples of cases he had. He actually had a case just like this, where someone was suing another person b/c of their marital problems almost a year after they had an accident. They were suing for over 70,000 and he defended the guy getting sued, and you know what happened. He counter sued and won 70,000 from the couple suing him plus a large amount in compensation for pulling something as stupid as this. It's possible to sue for anything and the right to for a case like this, however, they will not win. Counter-Sue and you will win hands down, lets see, 25,000 from the case plus what, about 50,000 in comp:D
 






I am thinking that I would need the original amount of the suit plus another $25,000 in compensation for time lost plus $15,000 for mental anguish plus $1.5 million for punitive damages (call this the idiot tax they have to pay for being dumb in public)...

Thats what I love about our system, someone can sue you for something stupid and minor, then you can counter-sue and collect 1.5 million.:D Gotta love em' dumbazzes;)
 






1st. Call your insurance and talk to them, they will help as it may be them paying for it. :P

2nd. READ!! Go check out Tort Laws Dead Link Removed

3rd. Tap the resources, if in college or friend (SaleenEXP) for example. My law teacher was a sit in Judge on the Supreme Court. 1 Smart, Smart lady.

4th. Find reasoning for countersuit and gather ALL information. As this is too much for small claims be prepared to "submit" evidence (gathered from talking to your insurance Co.) under discovery of evidence.

5th. Dress nice, go to court get sued, win and counter sue for compensatory and punitive damages and wages lost as well as court fees and such.

OK here's what happened.

last year i ran into this guy (rearended) with the company car. The brakes failed and it didn't stop. (Damm ABS) So we swaped each other info. Then went are seperate ways. When i get back to work my boss tells me to lie and say i borrowed the car for personal use not work. You see it was put down on his personal ins. for use not for work cause he's cheep. So now they filed a lawsuit (the people i hit) against me and my boss the owner of the car. There clamming for personal inj., loss of use of ther car of whatever, general damage (whatever that is) and loss of cortism. (i think i spelled it right.) Which is basicly he sewing me because his wife can not provide the love , conpanionship, and blah blah blah. ( He's not getting any!) This couln't be that there 70 or 80! I got a letter from an attornys office that they were sought by the ins. company to defend us. and to notify tham when i get summond. Sorry so long. But this is really stupid. O' yeah they made the one year date by 9 days.
 






I would do my best to bow out and let the boss and his Co. take the brunt. It sucks he told you to lie now you have a real Fawking mess that opens a whole other can-o-worms. Best wishes.
 






I would go to the police dept. and see if a report was filed. If no report was filed its their word vs. yours. Go talk to one of those lawyers that doesn't collect anything if you win.
 






Your insurance company should porvide you with a good attorney , you should not have to pay for an attonrey nor for any damages and losses. That is what insurance is for.
I feel your pain though. My ex-fiance' is suing me for a quarter mil. over an accident we were in back wile we were together. Life is a bit** and I almost married one.
 






...............and next, get another job. Who knows how many other ways your boss is being "cheap".

whoo hoo, another Kalik lover. Damn, I actually didn't think they had it North of Fl. for some reason, even people down here don't know about it. Thats the best beer I've ever had, actually my mom just bought me a case the other night that I havn't touched, so I'll go crack open 2 and drink one for you:D

Also, again definitly counter sue, no contest that you'll win against those senile people. What about your boss? Sue him too under forceful pretense for 2 million:D That way when you lose your job, you be damned set! :D
 






You should notify your own insurance co. since they are naming you in the suit. Your bosses insurance co. is going to do whats best for their policy holder (boss) and them. You dont count.
So you need to have your ins. co. be aware that you may need their help. Soon as you get some papers get a copy to your co. If you need their help you have to notify them as soon as you can.
Dont hire a lawyer for yourself. Your ins. co. will do that.

Bill's right, we used to own an Insurance company, and I will tell you the Insurance will only cover the company who the policy is with and your boss's insurance will only cover him, do not let him tell you otherwise or try to lead you on. The insurance will only do whats best for itself and who they cover, nobody/nothing else matters to them.

I say counter sue the senile couple, and sue your boss for metal anguish and stress;)

Do you know for sure if they are going threw with the suit??
