Here's the Deal

The ins. i had then i don't have anymore, i changed companys. Also the attorys office which the ins. got, says there representing me and my boss. I was given permision to drive the car and he has stated that. Was i covered under his ins.?

Ok, been here before.
The insurance company has retained a lawyer to represent you guys. He had a policy with an upper limit for liablity (generally $100K.) His insurance company offerred to settle with the litigants for a too small amount (in their eyes) and they elected to sue. Here's what will happen.
1# Depositions will be taken from all involved parties. Be at theirs if possible, but KEEP YOUR MOUTH SHUT when they are talking.
2# Legal firm will probably hire surveilance on couple to determine if their claim to marital disarray is valid (this will include interviewing anyone necessary)
3# Lawyers (yours and theirs) will argue for a long time (1-2 years is quite possible). Litigants will switch lawyers a few times to lengthen the process.
4# Suit will be dropped OR suit will go to court. Rely on your attorneys to handle anything, and DO WHAT THEY TELL YOU.
5# If you lose - remember your covered for probably $100K anyting over that won't be a problem either. After winning a settlement, Their attorney will offer to represent you in suing the insurance company for not settling when they coud - as long as the attorney retains any funds recovered above and beyond the settlement amount.....Big bucks for the attorney-incentive!

All in all - you'll probably just break even (lost work time maybe for depositions or court appearances) Tell your attorney the situation regarding the use of the vehicle at the time of the accident. You may have been on a break or at lunch and therefore legally using the vehicle for other than work purposes anyway.

Good luck,

Douglas

Who was at fault for the accident. And if their marrrage fell apart because of this accident then they didnt really have a marrage at all and they are looking for somone to blame. What the hell would a car accident have to do with ending a marrage? Unless the guy was driving to his girlfriends house when he had the accident and had to explain to his wife what he was doing in that part of town.

If I were you I would notify the ins. co. you had at the time. They may be involved. It cant hurt you and it may help. No matter what the ins. co. atty. tells you, you are not one of their insureds. You need to protect yourself & thats what your ins. co. is for.
Go see them...
