Ticket for accelerating too fast with my 35s and stock gears

That's right, I managed to get a ticket for accelerating to fast with 35x12.5 tires and 3.27 gears. I have exhaust and intake on my car so its pretty loud, and i took it up to about 4000 RPMs in first and then let off the gas and tapped the brakes because my speedo was crawling up towards 50. (45 on my speedo is 55 actual). Anyway, cop comes flying up behind me and throws his lights on and I pull over. He tells me I'm being audio and video recorded and blah blah blah. Tells me I was going at least 65 and that it's costing me $108 to hear my exhaust. Takes my stuff and goes back to the car. Comes back like 15 minutes later and asks me to step out of the car. He starts asking me about my bumpers and how I would kill someone if I hit a car accelerating like that (by the way there were NO CARS ANYWHERE IN SIGHT!) I tell him they are within the legal limit. He starts giving me attitude and asks if I'd like him to measure them. I tell him to go right ahead, they're both 29.5" and the limit is 30". He quickly shuts up about that and starts giving me grieve for my tires sticking out past the body line. I just got them covered up with my homemade fender flares a month ago but supposedly they don't cut it anymore. I have to make them go another 4" lower in the rear b/c it doesn't follow the whole body line. (I'm gonna cut off the 6" chrome thing that wraps around from the bumper so I don't have to do that :D) Gives me my ticket, tell me he's being nice and giving me "careless driving" not "reckless driving" so I won't loose my license. And he wrote on the ticket (I quote) "def. exelrated over speed limit at night". Wtf is exelrated? So anyway, I guess I have to go to court b/c its not against the law to accelerate a vehicle to quickly, especially since its pushing 35" tires and my 0-60 time is about 15 seconds. He didn't record my speed any other way then his guesstimation so. :thumbsup:

I have respect for law enforcement, but its just BS like this that pisses me off.

dont feel bad, last night i was leaveing a family members house and was warned about cops on a certain road being everywhere pulling people over for speeding ....so i leave ...got past a small store and sits a police car with lights on(head lights) . i'm going the speed limit and i pass him and look in the mirror to see if he was leaveing and he was still there till i got past a curve.4 minutes later the patrol car comes barrowing down on me he must have been doing 80-90 with no blue lights going ...follows me for about 8 more miles then pulls into a subdivision entrance and turns around :rolleyes:...i mean ....:wtf: ? i guess when the economy is bad for all that includes police as well ...

they got to make that quota on tickets each month :rolleyes:
 






yeah cops can suck. my last ticket was a seat belt violation. i was trying to parallel park in downtown while doing so i unbuckled so i could turn around easier. while starting to back up some yuppie flies into the parking space which of course pissed me off. so i say a few choice words and drive around the block to find a another spot. as soon as i turn the corner i get pulled over for no seat belt. told the cop what happen he said he didn't care. but here comes the best part while he was writing my ticket a piece of ghetto trash comes riding through downtown on a MINI BIKE weaving in and out of people on the side walk and driving the wrong way on a one way street weaving in and out of traffic. the cop comes back to window and just wondering i asked if he called in the guy on the mini bike. the guy says well i don't see him now so its not my problem. i asked what about all the people he just endangered, at least i was only endangering myself. the cop said to drive off other wise he was going to arrest me. so i started pulling away with my middle finger up and yelling "#### the police".

a month later i almost got arrested for trying to use a public bath room at the state fair.

both times it was the illinois state police. i don't like them too much now.
 






I looked online, everyone says as long as you didn't: spin the tires (impossible to do in this thing), weeve in and out and around traffic (it was a one lane highway and I was the only car both directions), or we're racing against another car (again, I was the only car); to fight the ticket and it'll get dropped. There is no law that constitutes accelerating to fast as a violation, if I spun the tires or were "racing" against another car or around cars then yes it's careless driving. But when me accelerating my 1994 Ford Explorer with a stock 0-60 of about 10 seconds and with 35" tires, I'm sure a corvette at 1/8 throttle will accelerate faster.

i live in south carolina and the cops have been going over board this past week with the ticket writing my brother and i both work at the same place and i was behind him on the way to work when out of no where this cop cuts in between him and me. cop pulls him over so i pull over to. the cop said he guesstimated that he was doin 60 in a 45 because of the distance he was between the other cars. no radar or nothing when the cop was coming back to his car i asked him what he pulled my bro over for and when he told me guesstimated the speed i asked where he learned how to do that and he said they are trained to do that. i got smart with him and said i work on cars for a living and im trained to do that but does not mean i am a 100% right on the diagnosis of the problem all the time. and asked if he was sure if we went to court he could be 100% that he was doin 60. Cop said im just goin to write a warning for him.
 






Be carefull and do your homework if you want to fight it, there may not be a "accelerating to fast" law but most if not every state has some sort of "exhibition of speed" or "speed more than resonable" law, which is pretty much the same thing. I know it may sound weird but its a law everywhere. If you were just accelerating normally then there would be no reason to even come close to 4 grand on the tach, and with your exhaust and intake it would just draw more attention. Spinning your tires defense wont hold up in court, it wont beat the burden of proof that you need to win the case.

Around here it's called "exhibition of speed." Just because you don't spin the tires doesn't mean you're not going too fast. I recently saw a dumbass in a lime green Lambo (don't think he saw the cop on a motorcycle sitting next to him...) take off from a light and probably redline 1st and 2nd gear, not spinning a tire. Needless to say, he got pulled over. Granted, your truck isn't nearly as fast as the Lambo, it's the same principle.

With that said, I'd still fight it. :)
 






My wife is a deputy court clerk(city court and they handle the traffic tickets) and she says its called exhibition of speed, and you did get of easy. They can ticket you for reckless/and or confiscate your car(here anyways). Might be different where you live, so I would contact your court and find out for sure if thats the way it is. Where we are though you can ask for a deferred sentence and as long as you stay clean for 6 months, its wiped off your record(city court). Look int it first and not from a friend.......
 






I'll fight it, worse that'll happen is that I'll have to pay $108. I believe I'm also getting slapped with 3 points for it too. So it makes me want to fight it even more. Guess I'll see what happens

Might see if they still charge you, can you possibly do some community service instead of the points on the license. Down here my buddy washed cop cars for 4 saturdays instead of 5 points on his license.

I have respect for law enforcement, but its just BS like this that pisses me off.

Local or Statie? What vehicle code section/subsection were you charged with exactly? You said Careless, but I wanted to be sure, it will be 3714(a) if you are correct.

I hope this doesn't become another lets hate the police thread.

Go to court and fight it.. there is no way someone can accurately guesstimate someones speed. Often times the police will hear a loud exhaust tone and make the incorrect assumption of speed. This is even more noticeable with the gearing and tire combo you have which forces you to push the engine to 4grand to marginally accelerate (3.27 and 35" are a dog combination) The icing on the cake will be when you tell the clerk/judge the officer's dash cam recorded the incident and a simple review will clear you. If the officer doesn't have the video then state it must be convenient for it to be missing as the officer was emphatic that you were on both audio and video..
 






I got pulled over in my Camaro SS once for the exhibition of speed thing. No other cars around but I barked the tires from first to second. Speed limit was 55 and I admit I was having some fun so I goosed it barked the tires then hit the brakes when I got to 55. Cop pulled me over (I felt pretty stupid as he was sitting in plain view but I just didnt see him) Luckily the cop was cool, we talked for like 10 minutes about that law and since I really did not know about it, was not racing anybody and I slowed down right at 55 he just let me off with a warning. So do your homework and go ahead and fight it but be prepared to pay the 108 plus some court costs possibly. i think in Alabama they charge you like 10% traffic court costs or something.
 






you got off lucky.. a few years ago a friend of mine got a ticket for wreckless driving for chirping a tire on a 89 buick lesabre pulling out of mcdonalds. it was $365.

after my accident in my 97 my sister called bc she had run out of gas, the only vehicle that was running was my 97 but it was half way tore down. hood wasnt latched, no header panel, to front bumper, to headlight lenses, just bulbs sticking out... got pulled over with 4 friends in the car by a cop who assumed we had drugs and asked to search the car and threatened to bring the dog in to sniff for drugs. luckily i remembered the officers first and last name from the day of my accident who told me that since this was my only vehicle that if i had to use it in an emergency that it would be ok and to show any cop who pulled me over my ticket. i did so and the cop got an attitude.. "this is the 2nd time i saw you tonight, you were over by watson driving earlier, was that an emergency?" "well officer considering thats where i live i had to drive through there to get to where you have me pulled over now" "well i better not catch you driving again tonight" "well i have to drive back home the way i came so if you see me thats what im doing" "license and registration.. do any of you have any drugs that you want to tell me about" that was pretty much the end, i could have gotten in a lot of trouble driving like that but i had the ticket where the officer wrote down 'emergency use till repair'


some cops are just a-holes, others are awesome. some laws are ridiculous.

Holy **** $365 ticket!! Wow I did get off lucky. I do know that it would have been like 4 or 5 points I can not quite remember. Also what might have helped was when I told him I had aftermarket equipment like clutch, intake, exhaust, chip. I was trying to make it seem like it was hard not to chirp the tires. Either way I guess I did get lucky. Man do I miss that car.:(

Gotta make money for the city, state, county... They're all poor these days and doing whatever they can to bring in extra revenue.
