2006 ford explorer with too much transmission fluid

I had a tranny flush less than 3000 miles ago. Just recently noticed small amounts of tranny fluid on the garage floor. Took it to the dealer and they explained their mechanic put too much fluid in the tranny and they drained it to the right level and said wait a week and see if it stops. Well, it hasn't stopped. 2006 ford explorer xlt 4wd 4.0 V6, had tranny replaced 40000 ago. I had no shifting problems or anything like I experienced with the original transmission. The mechanic that did the work charged me for 16qts, and the tranny holds 13qts. 3 quart overfill. Did not notice any leakage until about a month ago, the question I have is: Could this overfill have damaged any of the gaskets that hold the fluid? The dealer says in order to find the leak they have to drop the tranny, about $1200-$1500. Then fix whatever is wrong. Shouldn't they be doing this for free. Everything I read mentions that the seals and gaskets can be compromised with too much fluid. Any thoughts??

Yes an over fill can cause seals to leak. Hate to say it, but good luck getting them to step up to fix the issue they caused.

Not sure where you got the fluid capacity from, but the maximum capacity is only achieved when the torque converter is dry. If they just pulled the pan and filter, drained the fluid and refilled, the amount of fluid needed would be less than if the entire unit was bone dry, such as after a rebuild.

If they did a flush service it is common to use more fluid then it holds because it is actually being flushed through the trans as it’s running and some fluid is wasted which would explain why you are charged for more then it holds

Auto trans is a crankcase, as it gets hot the fluid expands… if your vent is pinched or dirty and not able to breathe the fluid will push out past the seals. Any time a trans or diff leaks first thing to check is the breather / vent

Did you get a warranty? Did the same shop that built your trans perform the fluid service?

I am sure the overfill blew a seal I agree w these other dudes
But it is good practice to check the breather

Sounds like the overfill resulted in a blown seal -- hence the, leak. And yes, being that they admitted fault regarding the overfill, they should take care of it. Upcoming, true test of your negotiation skills -- or a trip to small claims court.
