Would you fight this speeding Ticket?

Fight the ticket but be respectful of the court and the judge/officer/etc. You didn't mention how he obtained the speed he placed on the ticket. Take pictures of the speed limit signs before and after the location where you saw the office, make sure you show in plain view the street and any significant markers like a building or something. It could have been simply a oversight on him by putting the wrong speed down unless he did tell you what speed he clocked you at. In most states if you go to court and you plead not guilty and are still found guilty you will probably face the maximum including points. Most states being in a recession would rather have someone say guilty but with a reason and just issue PBJ with a fine. Depending on your driving record it may best to either plead guilty and hope to get PBJ. You have to remember in the court, the officer has the burden of proof already behind them.

I always try my best to be respctful when dealing with the courts or cops.I just dont know how he get that i was doing 65 in that short distance from where i turn onto that street to where i passed him.I would have had to floor it in an all out dash to even come close to that speed in that short distance. and being that i just replaced the heads on it after it ran hot on me a few weeks ago, i been babying the explorer.
 






ok now get this on my way home today, i take the same road to and from work, the speed posted on the east bound lane which the cop was traveling is posted as 35mph but in the west bound lane that i was traveling headed to work its posted as 45mph, the sighns are about 20 yards from each other.
 






Don't go into court and just talk you must go into court with facts proving your case. Unfortunately speeding tickets are guilty until proven innocent. You must read the citation.


If you were going westbound it should be noted on the ticket. If it gives a location then you need to take a picture of the location and the sign.

It also must say how he calculated that speed.

If he was traveling eastbound and you were traveling west bound if he was going 34 and you were going 30 if he hit you with radar wouldn't his radar read 64 mph. ( I am not sure).

Anyways it only matters what he says if his audio recordings and dash cam is requested as evidence.

If you are going to fight it you need to fight according to the facts on the ticket.

Notes documents and pictures not just words are required.

As for me I would go plea no contest pay the court cost and take my traffic school.

Umm I doubt two opposite directions would have different speed limits unless you were entering city limits and leaving city limits. With that said, I would contact the county's engineering department to determine which is the correct speed limit if its not a simple entering/exiting city limits/borders/etc.

Join the National Motorists Association - http://www.motorists.org/ - it won't help you much this time, but the next time you get a ticket, if you fight and lose, THEY will pay the fine.

There is a very good chance that the cop won't show up in court, or the ticket will be dropped before your court date.

Having said that, be prepared to lose if you actually have to go to court. Forget everything you thought you knew about Constitutional rights - you gave them up when you accepted the "privilege" of driving. You probably won't have a judge - it'll be presided over by a lawyer acting as a "hearing officer". As far as I can tell, the system is modeled on Soviet kangaroo courts.

And if you can save up a few hundred bucks, buy a Beltronics Pro or Valentine radar detector. A top of the line radar detector is worth its weight in gold.
 






Two different speed limits on the same stretch of road is not as unusual as it seems. Here in NJ there is a road where the border between two towns runs down the yellow line in the middle of the road. On the southbound side, the speed limit is 35mph. On the northbound side of the same road, which is in a different town, the speed limit is 25mph... Go figure.

I say take pics and fight it.
 






And when the Trooper was handing me the ticket he said if i took it to court he would show up and tell the judge that i was really doing the 64 in the 35 and suggest that my driver liscence be suspended and that i take a 40 hr drivers class for doing almost 30 over the limit.And that really pissed me off cause now i feel that he was threatenin me not to fight it.

Fight it and "call" the cop's bluff. It sounds like the cop has no interest in showing up to court. If he doesn't show up within ~ 15 minutes of your scheduled time, then politely motion to dismiss based on lack of supportive evidence. If what you say about the cop's statement is true then yes, it is a thinly veiled threat not to challenge him. They say things like this to mostly younger adults who aren't acutely aware of what their rights are. Much to the cop's chagrin, everyone has the right to due process and their day in court. If the cop has the cahounas to actually mention that in court, then you could mention to the judge that you felt this was a threat and intimidation to your right to due process and you're motioning to dismiss based upon official oppression. You could argue the example of misconduct by politely asking what penalty you would receive if you filed a false police report? Then ask what penalty would an officer receive if he files false speeds on a ticket? Always ask to see the judge's copy of the ticket as this may contain little subversive messages to the judge like drawings of a frown or smiley face, or outright notes of your behavior at the time of the ticket. If any is present, then motion to dismiss based upon prejudice. It's important to dress respectfully and possibly bring some well dressed friends with you. It is difficult to get a fair trial in traffic court because the judge AND the cop both work for the state and their job is to separate as much cash from you as possible in order to bolster their retirement fund. If you are well dressed, polite, and articulate, judges are *somewhat* intimidated by the fact that you may be an active registered voter and will organize some massive campaign to unseat them in the next election cycle, so your professional conduct is important. Also, from "Ticket 101 class," never say something like,"I was going a little over the speed limit, but I wasn't going that fast." That will immediately end your case! Cheers --Lizard

Good for your dad. Say, isn't Palm Beach the city where a cop was fired for writing hundreds of false traffic tickets mainly against people "of color?" No offense but cops lie and radar/laser/doppler are not exact sciences. You make your dad out to sound like some kind of a control freak which may or may not be true. Through gestapo unions, police have totally forgotten that they work FOR the taxpayer. Cameras, Radar, speed trip wires, warrantless GPS attached to your vehicle, thermal imaging, X-ray of your house, photo enforcement cameras, civilians in roadside photo vans spying on motorists, illegal "Sobriety Checkpoints" where you get issued tickets for burned out light bulbs, and everything not DUI related, warrantless tracking via cell towers, etc., etc. As many societies around the world are demanding democracy, we are slowly losing ours. Our society is quickly getting fed up with big gov't, aka "big brother" controlling every aspect of our lives. Eventually, there is going to be another revolt and I'll put in a prayer for your dad.:us:

I have no problem with him showing up, but how dare he threaten me like that if i take it to court.And either way the ticket he wrote is wrong the speed on my side was 45 not 35 so that ticket for 44 in a 35 is flat out wrong.
 






Here is a thought- maybe the traffic signs designate the change of speed limit mark. The eastbound changes from 45 to 35 at that point and the westbound changes from 35 to 45. I had a co-worker (on a military base) given a ticket for "anticipating a speed zone", he sped up to the speed BEFORE the sign. (I think the SP had a grudge against him, though.) Like you, I don't see a gen 2 ex hitting 64 in less than a quarter mile accidentally.

Also, if he was using a radar, it should list what radar on the ticket. There's one type of radar they use that is notorious for reading fast by a good margin... can't remember the name, but i got ####ed over by one a year and a half ago.

It's getting to the point that we civilians need in dash recorders to bust the lying/dirty cops.

there is nothin really on the ticket beyond it saying 44 in a 35, the closest intersection to where he pulled me over and the brand of speed detection unit that was used.Also i passed him after i had passed the posted speed limit sighn of 45 but less than 20 yards pass the posted 45 sighn on the other side of the road headed in the oppisite direction from which i was going the sighn does say 35.

I make one simple statement and you come out, guns blazing, with some crazy conspiracy rant. Sounds like you have some issues there, buddy.

So, If you take pictures of where you were pulled over, with the speed limit sign etc I think you will be ok.

At that point the facts will be you have a ticket stating you were doing 44 in a 35. You will have proof that you were actually in a 45mph zone. If at that point if the cop wants to bring up that he actually falsified the ticket I think that alone or in combination with the fact that the cop didn't know what the speed limit was there means the ticket will be thrown out.

Now, if where you were pulled over was a 45 zone but where hey tagged you was 35 mph zone then I think your screwed. You will have to go farther back down the road to find a speed limit sign there to know what it was when you pulled out.

In that case, its a bad ticket. He wrote you for doing the speed limit.

That means you fight it as if you were doing the speed limit and let the Cop incriminate himself. Don't forget pictures of where you pulled out from to where he nabbed you including measuring how far it actually is.

With that said, As I understand it, a slight mistake is allowable. I don't know how "slight" the speed he wrote on your ticket will be.
